Search and Seizure Warrant (1)

On January 29, 2009, at approximately 2200 hours, the Frederick Police Department’s Drug Enforcement Unit served a search and seizure warrant at 118 Lauren Court, Frederick, MD. During the search, officers found a quantity of marijuana, over $300.00 and drug paraphernalia. Three people were arrested. Those arrested were identified as Rashad Lyles, Michael Lyles, and Eshe McIntyre. The arrestees were transported to the Frederick County Adult Detention Center to appear before the District Court Commissioner.

DUI/Drug Arrest

On 01-28-09, at approximately 1830 hours, OFC Scott McGregor of the Frederick Police Department observed a vehicle being driven by the arrestee, Christina Alliece Strange, very erratically in the 100 through 400 blocks of N. Market St., Frederick. He was able to initiate a traffic stop on the vehicle and quickly ascertained Ms. Strange was under the influence of alcohol. She was unable to satisfactorily complete Standardized Field Sobriety Tests. Once OFC McGregor placed her under arrest, he found that her tags were suspended and her driver’s license was suspended for a previous alcohol violation. OFC McGregor also located a small baggy of powder cocaine in her purse. She was arrested and taken to Central Booking and held on a $15,000 bond.

Stabbing


On the above date and time, officers responded to 209 W. 5th St for a stabbing. Once on scene, they located a large amount of blood at the front and rear doors of the residence. The residence was locked and forced entry was made to locate victims and or suspects. No persons were located inside the residence, but FMH advised that a person with a severe chest wound just entered their emergency room. Officers contacted the victim and he explained that an altercation occurred inside the above residence. The altercation occurred when the suspect attempted to leave the residence with the victim’s hat. When the victim attempted to retrieve the hat, he was attacked with a knife. The suspect has been identified as Paula Denise Fatka (Photo right), W/F, 05/27/1981, 5’6”, 125lbs, long black hair, brown eyes, numerous scars and tattoos on each arm. Checks of the area were negative. Anyone with information on the location of the suspect is asked to call the Frederick Police Department at 301-600-2100. The victim, Steven Alan Burdette, 26, was in stable condition at FMH at the time of this press release. Mr. Burdette was found to have an open arrest warrant through the FCSO for CDS charges and he will be placed in their custody upon release.

Crime Initiative

The Frederick Police Department encourages citizens to be vigilant in protecting their neighborhoods and neighbors. With the recent increase of crimes against citizens the members of the Frederick Police Department would like the community to know that the

FPD is using every available resource to reduce street crimes in the City of Frederick.

A few tools used by the Department to combat this increase include the following:

  • Increased visibility in areas identified by FPD Crime Analyst
  • Plain clothes surveillance and decoy operations
  • Increased Field Interviews of persons acting suspicious in targeted areas
  • Crime prevention tips available to public
  • Provide whistles for Whistle Defense initiative.
  • Upon arrest, the Community Prosecutor/Edward Lulie will ensure the proper follow-up and aggressive prosecution of those arrested.
  • Requested the assistance of Maryland State Police for increased visibility in the Rt. 40 area during the months of October, November and December.
  • Detailed Crime Analysis and comparison with surrounding jurisdictions.

Crime Prevention Tips:

Personal Safety Tips on the Street

  • If possible, don't walk alone during late-night hours. Walk in groups whenever you can—there is always safety in numbers.
  • Let a family member or friend know your destination and your estimated time of arrival or return. That way, the police can be notified as quickly as possible if there is a problem.
  • Stay in well-lit areas as much as possible. Avoid alleys, vacant lots, wooded areas, and other short-cuts or secluded areas. They are usually not well-lit or heavily traveled.
  • Walk on the sidewalk whenever possible. Walk close to the curb, avoiding doorways, bushes, and other potential hiding places.
  • If you have to walk in the street, walk facing traffic. A person walking with traffic can be followed, forced into a car, and abducted more easily than a person walking against traffic.
  • Walk confidently, directly, and at a steady pace. Don't stop to talk to strangers.
  • Wear clothing and shoes that give you freedom of movement. And don't burden yourself with too many packages or items.
  • Always be aware of your surroundings. If you are wearing headphones, don't turn up the volume so high that you cannot hear outside noises.
  • Never hitchhike or accept rides from strangers.

  • Avoid carrying large sums of cash, or displaying expensive jewelry in public.

  • Send the message that you're calm, confident, and know where you're going.
  • Trust your instincts. If something or someone makes you uneasy, avoid the person or leave.

  • Check out the locations of police and fire stations, public telephones, hospitals, and restaurants, or stores that are open late.

If Someone Tries to Rob You

  • Don't resist. Give up your property—don't give up your life.
  • Report the crime to the police. Try to describe the attacker accurately. Your actions can help prevent others from becoming victims.

Safety in Your Vehicle

The crime of “carjacking” – which is stealing a car by force – captures headlines across the country. Statistically speaking, however, your chances of being a victim of carjacking are very slim, and taking preventive measures can reduce that risk even more.

  • If the carjacker threatens you with a gun or other weapon, give up your car. Don’t argue. Your life is definitely worth more than a car.
  • Get away from the area as quickly as possible.
  • Try to remember what the carjacker looked like—sex, race, age, hair and eye color, special features, clothes.
  • Report the crime immediately to the police.

Frederick Police Explorer Post wins award

At the National Capital Area Council Annual Exploring Banquet on January 17, 2009, the Frederick Police Department’s Explorer Post #714 was honored with the William H. Spurgeon III Award. This award is the highest recognition for individuals and organizations contributing significant leadership to the Exploring program. The William H. Spurgeon III award was developed in 1971 in honor of the man who is regarded as the major leader in the development of special interest Exploring. His efforts led to the present Exploring program. The Post was also nominated for Community Services Post of the Year, which they won in 2006. Explorer Advisors are: OFC. Jason Essel, OFC. Christopher Herman, OFC. Samantha Payne, and OFC. Michael Auge’. Drug Arrest

On 01/24/2009, at approximately 1628 hours, the Frederick Police Department’s Drug Enforcement Unit was conducting surveillance in the area of the Lincoln Apartment complex. During that time, officers observed a suspicious vehicle leave the area. After following the vehicle, officers observed the driver commit a traffic violation and the vehicle was stopped. A K-9 sniff of the vehicle was conducted and a positive alert for drugs was observed. Upon searching the vehicle officers found marijuana. Consequently, the driver (Larrick) and passenger (Thompson) were arrested.

Larrick and Thompson were transported to the Frederick County Adult Detention Center to appear before a District Court Commissioner.

Drug Enforcement Unit

On January 23rd members of the Drug Enforcement Unit were conducting a covert operation in the area of 1000 Heather Ridge Dr. Officers observed a vehicle enter this location. The occupants in the vehicle were observed to be engaging in suspicious behavior, consistent with persons attempting to buy drugs. Officers conducted a traffic stop on the vehicle after the driver committed a motor vehicle violation. A K-9 officer responded to the scene to conduct a sniff of the vehicle. The K-9 indicated a positive alert to the presence of drugs emanating from the vehicle. The driver was placed under arrest based on the positive K-9 sniff.

Officers observed crack cocaine on the lap of the passenger and he was placed under arrest. Additionally, a search of the vehicle yielded a pipe used to smoke crack cocaine. The driver Payne, Marvin and the passenger Moten were both transported to the Frederick County Adult Detention Center for an appearance before the District Court Commissioner.

Crystal Park Apartments Robbery Arrest

On Friday, 01/09/09, officers with the Frederick Police Department responded to a report of an armed robbery at Crystal Park Apartments. The investigation revealed a call was made to Charley’s Restaurant requesting a food order be delivered to 810 Blakely Ct. When the delivery driver arrived at the address provided, he was immediately confronted by a subject believed to be armed with a black handgun. The subject threatened the delivery driver, who then dropped the food and ran. The suspect picked up the discarded food and fled on foot in the opposite direction. The victim was not injured during the incident. A search of the area was conducted, but the suspect was not located.

Det. Jorge Garcia of the Criminal Investigation Division investigated the incident and developed a suspect, later identified as Elwayne Ondra Daniels. During his investigation, Det. Garcia was able to obtain information which led to the issuance of a search warrant for Daniels’ apartment located at 818 Blakely Ct. On Saturday, 01/17/09 at approximately 11:45 pm, members of the Department’s Special Response Team and Criminal Investigation Division executed the search warrant at 818 Blakely Ct.

As a result of evidence gathered from the search warrant and information obtained during interviews, Det. Garcia applied for criminal charges on Daniels. An arrest warrant was issued for Daniels charging him with Armed Robbery, Robbery, 1st Degree Assault, 2nd Degree Assault, Use of a Handgun in the Commission of a Crime of Violence, Reckless Endangerment, and Theft Less Than $100. Daniels was arrested this morning and was taken to the Frederick County Adult Detention Center for service of the warrant. Following an appearance before the District Court Commissioner, he was being held on $7,500.00 bond.

The Criminal Investigation Division has determined that this robbery is not related to the two robberies of pizza delivery drivers on Heather Ridge Dr. that occurred on 01/07/09 and 01/09/09.

This arrest brings to a close four robberies committed in the City of Frederick since 01/08/09. During that time period, the Frederick Police Department has charged three adult males and charges against two juvenile females are still pending.

Drug enforcement Unit

Officer from the Drug Enforcement Unit were on routine patrol in the area of 1700blk. Kingfisher Dr. Officers overheard a male talking on the cell phone to another male about a drug transaction. Officers waited for the suspected drug buyer to arrive on the scene to complete the purchase. Once the suspect arrived, DEU members contacted him. This male fled on foot from the scene and was later identified. The suspected dealer was contacted and placed under arrest. A search incident to arrest, the dealer was found with a large amount of crack cocaine and currency.

Dixon was transported to the Frederick County Adult Detention Center for an appearance before the District Court Commissioner.

PAL Program announces return of Karate program

The Frederick Police Activities League is pleased to announce the return of it’s karate program at the PAL Center in the Sagner Community and at Hillcrest Elementary School. The kick off for the Sagner PAL Center will be on Wednesday January 28th from 4:30 – 6:30 pm and at Hillcrest Elementary School on Thursday January 29th from 7:00 – 8:15 pm. There will be an opportunity to meet the new karate instructor, Ms. Shelley Aloi, watch karate demonstrations, and to register your child. This program is offered for youth ages 8 and up. The PAL karate program is offered to the youth in the community free of charge.

The regular schedule for the karate program will be:

Sagner PAL Center - Monday & Wednesday evenings from 4:30 – 5:30 pm

PAL @ Hillcrest Elementary - Tuesday & Thursday evenings from 7:15 - 8:15 pm

The PAL Program is but one aspect of the Department’s multi-faceted, progressive approach to policing in our community in general, and reaching out to the City’s youth specifically.

The Police Activities League of Frederick (PAL) began in August of 1999, and is a recreation-oriented juvenile crime prevention program that relies heavily upon athletics and recreational activities to create and cement the bond between police officers and the kids on the street. During the school year the PAL program is offered in the evenings at the PAL Center in the Sagner Community and at Hillcrest Elementary School. PAL offers kids a safe nurturing place to learn and interact with the police officers all while having a good time.

Weather-related traffic accidents

On today’s date between 0700 Hrs and 1630 Hrs the Frederick Police Department handled 15 traffic accidents. The accidents were caused primarily by the poor weather and road conditions. No serious injuries resulted from the accidents. The Department of Public Works has been salting heavily. However, temperatures will get into the low 20’s tonight. This combined with the wet roads could cause severe icing. Citizens should refrain from driving unnecessarily, and use caution when operating vehicles within Frederick City during the evening hours.

Stolen Vehicle Arrest - Wilson, Moises

On today’s date, 01-13-09, OFC Hoxie of the Frederick Police Department’s Patrol Division responded to a stolen vehicle call in the area of 90 Waverly Dr. at approximately1300 hours. The owner of the stolen vehicle had lost his car key in the area of his parked vehicle, which was found by the suspect who determined what vehicle the key belonged to and stole the vehicle. Ofc. Hoxie began to canvass the west side of town and soon after the report located the vehicle parked in the area of 1204 Littlebrook Dr. He developed a suspect when he identified suspects loitering in the area and later discovered that one of these subjects had left items in the stolen vehicle that had his identity on them. Upon finding paperwork left behind in the vehicle with the suspects name on it, Ofc. Hoxie immediately re-contacted him and arrested him for the theft of the vehicle. Mr. Wilson was taken to Central Booking upon his arrest in order to have a bond hearing. The vehicle was returned to its’ owner undamaged.

Ballou, Kirk Xavier arrested for Armed Robbery

On Wednesday, 01/07/09 and Friday, 01/09/09, officers with the Frederick Police Department responded to reports of armed robberies in the area of the 400 block of Heather Ridge Dr. During both incidents, local pizza restaurants had received calls to deliver pizza to an address on Heather Ridge Dr. When the delivery drivers arrived to the address provided, they were beaten and robbed. A knife was described as being displayed during both incidents. The drivers had their wallets, money, pizza and cell phones taken during the robberies. One of the victims was transported to Frederick Memorial Hospital for treatment of facial injuries and was later released. The other victim did not immediately seek medical attention.

Det. Thomas Tokarz of the Criminal Investigation Division investigated both robberies and was able to identify two juvenile females believed to be involved in the Friday robbery. As the investigation continued, a 17-year-old male suspect was identified and taken into custody on 01/13/09 by members of the Patrol Division. The male suspect was interviewed and subsequently linked to both armed robberies. He was identified as Kirk Xavier Ballou, age 17, of Frederick. Based on the nature of the offenses, Ballou was transported to the Frederick County Adult Detention Center and charged as an adult with two counts each of armed robbery, conspiracy to commit armed robbery, 1st degree assault, 2nd degree assault, wearing and carrying a dangerous weapon and theft less than $500. Following an appearance before the District Court Commissioner, Ballou was being held on $375,000 bond.

Theft from Vehicle arrests

INCIDENT SUMMARY: Throughout the month of December and January, the Frederick Police Department had become aware of a rash of thefts from vehicles occurring primarily in the west end of the City. The number of vehicle break-ins were much higher than normally reported, which caused a coordinated investigated effort within different Divisions of the Frederick Police Department. Many of the break-ins had similarities that led officers to believe many of the break-ins were connected.

Ofc. Hoxie and Ofc. Bolden of the Department’s Patrol Division investigated three of the vehicle break-ins during the week of January 5th, and were quickly able to determine two suspects, Williams and Estep (see below). With the assistance of video surveillance from a local pawn-shop and home improvement store, Williams and Estep were identified as being involved in two of the vehicle break-ins and linked to numerous others. Ofc. Hoxie and Ofc. Bolden were able to obtain and serve, with the assistance of the Department’s Directed Patrol Unit, Drug Enforcement Unit, and Criminal Investigations Division, arrest warrants and search and seizure warrants for the two subjects. Both were arrested over this past weekend and are currently being held at the Frederick County Adult Detention Center.

Some of the stolen property has been recovered. The investigation is still on-going. The Frederick Police wants to remind the citizens of the City of Frederick that almost all of the property stolen from those vehicles involved in this investigation was property left in plain view in vehicles parked at the owner’s residences. You can prevent yourself from becoming a victim of such crimes by ensuring that all property of any value should be removed from vehicles when out of sight of the owner.

Armed Robbery

On 01-12-09 @ approximately 2043 hrs. Patrol Officers responded to 1086 Carlton Pl. in Frederick Heights for a reported Armed Robbery. The male victim was outside his apartment building with two of his children when he was approached by 3 young B/M’s. One of the suspects produced a handgun and robbed the victims of personal property and cash. Officers responded to the area but were unable to locate any suspects. Drug Arrests

On 01/10/2009 at approximately 2226 hours, OFC R. T. Wharton of the Frederick Police Department was on patrol in the area of the 1000 block of Heather Ridge Dr. when he observed a vehicle leaving an area known for a high level of CDS activity. OFC Wharton observed that the vehicle had an illegally modified exhaust system and stopped the vehicle in the area of T.J. Drive and Opossumtown Pike.

A K-9 officer was called to the scene of the traffic stop and the K-9 handler advised that the K-9 alerted tot the presence of a narcotic odor coming from the vehicle. The vehicle was then searched and a quantity of suspected marijuana was recovered from several places within the interior of the vehicle. The vehicle operator (Phaeton) as well as his three passengers were arrested and charged as listed below.

All of the arrestees were transported to Frederick County Central Booking for processing and appearances before the District Court Commissioner. All were released on their own recognizance.

Assault and Disorderly Conduct Arrests

On 01/11/2009 at approximately 0200 hours, OFC D. E. Stephenson was monitoring the area of the 100 block of S. Market St. as numerous local bars were in the process of closing. OFC Stephenson heard the sounds of an altercation and responded to the area of Citizen’s Way, where he discovered numerous people suffering from the effects of pepper spray and observed a male running from the area. Witnesses advised OFC Stephenson that the male had challenged the victims to a fight and had then pepper sprayed them and OFC Stephenson pursued the suspect and apprehended him a short distance away. At the time of his arrest, he was still in possession of a canister of pepper spray that had been used in the assault. This arrestee was identified as the below listed Nolan subject and was charged as listed. The investigation into Nolan’s actions continues.

While officers were dealing with the above situation, a second subject began interfering with the officers, yelling obscenities and causing a disturbance. He was told by several officers to cease his actions, but continued and was eventually arrested by OFC M. A. Irons. This subject was identified as the below listed Ruppert arrestee and was charged as listed.

Both arrestees were transported to Frederick County Central Booking where they were processed and had hearings before the District Court Commissioner who released both men on their own recognizance.

Drug Enforcement Unit

On this date members of the Drug Enforcement Unit served a search and seizure warrant at 90 Waverly Dr. FF301. During the service of this warrant, officers located a quantity of marijuana. Additionally, officers located drug paraphernalia throughout the residence. The residents came home during the service of the warrant and were placed under arrest.

Both subjects were transported to the Frederick County Adult Detention Center for an appearance before the District Court Commissioner.

UPDATE: BB&T Bank Robbery - Beals, Jonpaul Loren arrested

On 01/08/09 at 3:41 pm, the Frederick Police Department responded to the BB&T bank located at 1370 W. Patrick St. for a report of an armed robbery. Preliminary investigation revealed a male entered the bank and approached a bank counter. While at the counter, the male produced a handgun and demanded money from the bank teller. After receiving an undisclosed amount of money, the suspect fled the bank in an unknown direction. The suspect was not located during an initial search of the area. The suspect was described as a white male, average build, wearing a gray hooded sweatshirt and blue jeans.

UPDATE:

While investigating the bank robbery at the BB&T bank on W. Patrick St., the Frederick County Sheriff’s Office received a report of an armed robbery at the Giant supermarket on New Design Rd. at approximately 4:06 pm. Minutes later, another robbery was reported at the Rite Aid pharmacy on New Design Rd. and Crestwood Blvd. The suspect description in both robberies matched that of the suspect from the bank robbery at the BB&T bank.

Detectives from the Frederick Police Department responded to the Rite Aid pharmacy to assist deputies with their investigations to determine if the robberies were related. Investigators from both agencies were able to link the robberies to the same suspect through video surveillance. During the investigation, a suspect was developed and later taken into custody by the Fredrick County Sheriff’s Office. The suspect, identified as Jonpaul Loren Beals, age 29, of Frederick, was interviewed and information was obtained linking him to all three robberies.

Detective William Forder, an investigator with the Frederick Police Department, charged Beals with the robbery of the BB&T bank on W. Patrick St. Beals was charged with Armed Robbery, Theft Over $500, and Use of a Handgun in the Commission of a Crime of Violence.

Drug Enforcement Unit

On this date members of the Drug Enforcement unit were conducting surveillance in the area of Pennsylvania Ave. and Hope Circle. Officers observed a male who was identified as Smothers, Izaiah conduct a drug transaction with another male who was identified as Baugher, Curtis. Baugher exited the area in a vehicle and a traffic stop was conducted shortly thereafter. Baugher indicated he had given the suspected marijuana to another passenger inside the vehicle who was identified as Devilbiss, Lindsey. Both Baugher and Devilbiss were placed under arrest.

Officers located the suspected dealer Smothers and placed him under arrest. A search incident to arrest, officers located additional marijuana on Smothers. All suspects were transported to the Frederick County Adult Detention Center for an appearance before the District Court Commissioner.

Bank Robbery

On 01/08/09 at approximately 3:41 pm, the Frederick Police Department responded to the BB&T bank located at 1370 W. Patrick St. for a report of an armed robbery. Preliminary investigation revealed a male entered the bank and approached a bank counter. While at the counter, the male produced a handgun and demanded money from the bank teller. After receiving an undisclosed amount of money, the suspect fled the bank in an unknown direction. The suspect was not located during an initial search of the area. Hall, Michael Gordon - Arrest

On this date officers from the Drug Enforcement Unit arranged to make a purchase of marijuana. The suspected dealer arranged to meet officers in the 1700blk. Kingfisher Dr. to purchase $50 worth of marijuana. The suspected dealer contacted the undercover officer and completed the sale of marijuana. He was subsequently placed under arrest. A search incident to arrest of the vehicle in which they were driving, officers located an additional 13 grams of marijuana and a digital scale with marijuana residue.

The adult dealer Hall was transported to the Frederick County Adult Detention Center for an appearance before a District Court Commissioner. The juvenile male was transported to Frederick Police Headquarters and was released to his parents.

Commercial Burglaries

On 01/04/09 at 0423 Hrs members of the Frederick Police Department responded to 2060 Yellow Springs Road for two commercial burglaries. Responding officers discovered that the front doors to Pizza Blitz and Pablano Grill were shattered. Officers entered the businesses and discovered that they had been burglarized.

Officers made additional checks of other businesses in the area and discovered that the Coffee Table and Queen Nails located at 2401 Whittier Drive had also been burglarized and had their front doors shattered. An undisclosed amount of money was taken fro each of the businesses.

A suspect was seen and is believed to be a black male who was wearing a hooded sweatshirt. Crime scene technicians responded to process the scenes for evidence and the investigation continues.

Arrest - Fatka, Paula Denise

On this date members of the Drug Enforcement unit were conducting surveillance in the area of 400blk. W. South St. Officers observed a female identified as Fatka involved in a drug transaction. Officers moved in and placed Fatka under arrest. A search incident to arrest, officers found marijuana and crack cocaine.

Fatka, Paula Denise was transported to the Frederick County Adult detention Center for an appearance before the District Court Commissioner.

Shots Fired

On 01/01/2009 at approximately 0015 hours, Officers of the Frederick Police Department responded to the area of Tillman Place and Hillcrest Dr. for a report of “Shots Fired”. Upon arrival, officers found numerous shell casings in a front yard. Numerous witnesses advised that they had observed 2 males dressed all in black and that at least one of the subjects had been seen firing a handgun. The suspects then fled east towards Seneca Dr. and were last seen in the area of Hollyberry Dr. No victims or property damage were located. Hindering Arrest

On 12/31/2008 at approximately 2327 hours, several Frederick Police officers responded to the Hard Times CafĂ© at 1003 W. Patrick St. for a reported assault. Upon arrival, the suspect in the assault was found to be in the parking lot of the establishment. As officers attempted to speak to the suspect, they were approached by the below listed arrestee, who advised his intention of preventing the officers from speaking to the suspect. The arrestee was advised to stay out of the investigation, but continued to interfere, requiring at least one officer to pay attention to him during the course of the incident. It developed that the arrestee was in possession of information and property belonging to the suspect that was required to properly complete the investigation. When asked for these items, the arrestee admitted having them, but refused to give them to the officers. These items were not the property of the arrestee and he had no standing to refuse to surrender them. Guariglia, Rick Adam was given the opportunity to comply with the orders, but continued to refuse and was subsequently arrested for hindering the officers’ investigation

Assault Arrest

On 01/01/2009 at approximately 0050 hours, Cpl. M.E.Pue, III responded to 278 Longford Dr. for a welfare check. Upon arrival, Cpl. Pue discovered a City Cab with a subject passed out in the rear seat. The operator of the cab advised that he could not wake the subject and that the subject owed a fare to the driver.

Cpl. Pue was able to wake the subject, but while trying to explain the need to pay the cab fare, the subject refused to pay the fare or provide identification. When advised that he would be subject to arrest for theft of the cab driver’s services if he continued to refuse to pay, the subject shoved Cpl. Pue and was subsequently placed under arrest for assaulting him. The suspect resisted handcuffing, however with the assistance of the cab driver, Cpl. Pue was able to bring the subject under control and place him in handcuffs.

The subject was identified as Seal, Benny Orbin and transported to Frederick County Central Booking, where he had a hearing before the District Court Commissioner and was subsequently held on $6500.00 bond.
