Short Sale or Not To Short Sale


I get a lot of calls and questions about short sales. By now, from the media and I’m sure just about everywhere else, you’ve heard what a short sale is. It’s when a owner of a home becomes financially distressed whether it be loss of a job, death, divorce, or some unforeseen circumstance and they can no longer afford their home. They owe more on their home then what they can sell for, so they are going to go to the bank and ask them to accept a lesser amount then what they owe.

First a short sale will do less damage to your credit than letting a property go to foreclosure or doing a ‘friendly foreclosure’ (deed in lieu). Nobody seems to know exactly how much better for your credit score a short sale is rather than a foreclosure, but I consistently hear that your score will drop 100-200 points (I know that’s a big range. . . but nobody will commit). I’ve also heard (and read) that you can purchase a new home, depending on how quickly your credit score recovers, within 6 months to a year if you had good credit prior to the short sale (again note the ‘heard and read’- I haven’t actually seen anyone do it, probably a bit of fear factor after going through this process of ever owning a home again).

I’ve had people ask me should I miss my mortgage payment? Well, no one is going to tell you to miss your payment, however the catch 22 is why would a lender talk/work with you about doing a loan modification or short sale when you’re still able to afford your payment (you could take this as a subtle hint)? On that note: If you find yourself suddenly not being able to afford your mortgage, should you immediately list your house and try and do a short sale? The answer may be no. First thing you should do is contact your lender and see if they’ll work with you and do a loan modification to reduce your payment. It sounds so easy, but it might not be. Some lenders will have you fill out their loan modification package and then have you submit it to them and then submit again, and again, and again. Some lenders it seems can’t keep track of the paperwork, but hang in there. . . it may actually work. I’ve had clients that were able to get their loan modified by several hundred dollars and now are getting back on their feet. I’ve also had several clients however that have gone through the process only to find themselves running out of savings because it took so long and they end up having to do a short sale anyway. Keep in mind it could take 6 months for a lender to actually work out the loan modification with you, in the meantime you could go through your savings and still end up losing your home.

So then the question is do you skip the loan modification and go straight to doing a short sale? Maybe, however in most cases the lender is going to be basing the short sale approval on you having little or no savings. Remember, you’re in financial distress and that’s why they’ll work with you to do a loan modification or short sale.

If you’re at the point where even if the bank were able to do a loan modification you still wouldn’t be able to afford the home or you know it’s time to move on and cut your losses, then the first step is to find a knowledgeable REALTOR who handles short sales. The REALTOR will help you put together a short sale package that will be submitted to the lender. In the meantime your home will be listed, typically 5-10% below market value. Once you have a Sales Contract for your house the ‘short sale package’ will be submitted to the lender along with your contract and Market Analysis showing the history of the sale of your property and value. Usually it takes about 2 to 4 months for the Bank to begin reviewing your file (picture thousands of files on a person’s desk and yours is wedged in the middle). Once they begin reviewing your ‘package’ they will order a BPO (broker price opinion) to determine the value. They’ll have you sign forms, send more paperwork and then finally they will submit your package to an ‘investor’ who actually owns your mortgage to see if the ‘investor’ is willing to accept the short sale/loss. If they accept, within 30 days you go to settlement. . .if not then you may be facing a deed in lieu, also known as a ‘friendly foreclosure’.

The key to the whole process is to work with all parties involved-your lender, buyer, REALTOR, etc. Communication is the key especially when it comes to your buyer. Keep them in the loop. Remember your buyer is going to be waiting 3-6 months to buy your house. Try not to lose hope and always remember in this economy you’re not the only one going through this. I always tell my clients look around the grocery store. Just about everyone you see right now is going through some type of financial hardship. . .and this to will pass. One of my clients had a great point. . .with so many people going through this, when we get to the end of this economic crisis will credit scores really matter anymore? Just makes you think.

1st degree murder - Marshall Franklin Metz Sr.

On 09/29/09 at approximately 12:42 pm, officers responded to 753 Dogwood Ct. for a report of a shooting. Upon arriving on scene, officers located a female inside the residence suffering from two gunshots to the upper torso. The woman, later identified as Ann Sue Metz, age 60, was transported to Frederick Memorial Hospital where she died of her injuries.

The victim’s husband, identified as Marshall Franklin Metz Sr., age 65, was questioned by police at the scene and later transported to Frederick Memorial Hospital after experiencing a medical related condition.

Detectives secured a search warrant for the residence and continued their investigation. Based on evidence gathered at the scene and information gathered during the preliminary investigation, an arrest warrant was obtained for Mr. Metz charging him with 1st degree murder, 2nd degree murder and use of a handgun in the commission of a violent crime. The incident was domestic related.

A commitment pending hearing before a District Court Commissioner was issued while Metz is being treated at the hospital. He will have an initial appearance before a District Court Commissioner when his medical condition permits.

Global Health Crisis: A problem in all of our hands

Dr. David Walton - Doctor, Humanitarian, & Global Health Expert

Emmitsburg, MD - Mount St. Mary’s University is honored to announce a presentation by humanitarian and global health expert Dr. David Walton on Monday, September 28th at 7 pm. Dr. Walton is a graduate from Harvard Medical School and has spent years doing field work across the world.

His extensive research on global diseases contributed to a best-selling book and Pulitzer Prize winner, Tracy Kidder’s Mountains Beyond Mountains: The Quest of Dr. Paul Farmer, a Man Who Would Cure the World. Dr. Walton, at the time the book was written, assisted the main character, Dr. Paul Farmer, a leading global health and disease expert. Presently, Dr. Walton works alongside Dr. Farmer as a practicing clinician at Partners in Health, a global health organization.

Every year the Mount chooses a book for incoming freshman to read and study as a part of a first semester seminar. This year, the Mount chose Mountains Beyond Mountains. “The book speaks to our mission and delivers a powerful message that reflects the Mount’s pillars: Faith, Discovery, Leadership and Community and shows them in action in the world,” says the Mount’s Dean of Academic Affairs, Dr. Leona Sevick, “Dr. Walton’s presentation will provide Mount students and guests, a more in depth look at the global health crisis affecting all of us, and especially the poor such as those in Haiti.”

Dr. Walton also works as a physician at Brigham and Women’s Hospital as well as a valuable instructor at Harvard Medical School. He is the associate director of Hôpital de Lascahobas, a hospital located in Haiti, one of the poorest countries in the world and successfully completed the Doris and Howard Hiatt Global Health Equity Residency Program at Brigham and Women's Hospital. He is most recognized for leading STD prevention and care programs, and especially his supervision of HIV programs in Haiti.

Strong Arm Robbery

On 09-22-09 at approximately 2055 hrs. a 66 year old female was the victim of a strong arm robbery at the Frederick Shopping Center. The victim was walking near the Giant Eagle Food Store at 1305 W. Seventh Street when the suspect approached her from behind. The suspect took the victims wallet from her grasp and fled the area on foot initially. He was observed by witnesses entering a small Silver vehicle which left the area via the rear of the shopping center. The victim was not injured in the incident. The suspect is described as a W/M, 6’-03” with a buzz cut hair style. He is of thin build and has some facial hair. He also has blue eyes and a large tattoo over his left shoulder. The suspect was last seen wearing a White Tee shirt with the sleeves torn off, and blue jeans. The vehicle in which he left was occupied by several other subjects, one possibly a female.

Everybody’s asking…what’s in the box that the Weinberg Center staff, along with the assistance of the Department of Public Works placed on top of the Center’s Marquee this morning? The answer is a prediction! A prediction that could get you a refund on your ticket purchase and a chance to see the show for FREE, that’s right FREE… Mike Super, here on October 16th, has made a public wager with the community that he will be able to accurately predict the headlines that will appear in the headlines the day of his show (October 16th.) To prove it, Mike pre-recorded the predictions and sent them (a month early) to the Weinberg Center in a sealed FedEx envelope.

This morning, the Honorable W. Jeff Holtzinger, Mayor of the City of Frederick locked the prediction in a Frederick News Post single news copy box and the box was hoisted up to the Marquee. The box has been secured with locks, chains, and weights! After the box was locked, the key was given to Jacquelyn Bello, Assistant Manager of the PNC’s Citizen Office in Downtown Frederick where Jacquelyn has placed the key in a safe-deposit box. The box will remain locked on top of the marquee until October 16th at 3 p.m. when the box is lowered and Mike Super will be on hand to prove whether or not he could predict the headlines—a month early! If Mike is wrong, he has made a promise to refund the price of each paid ticket that evening. The public is invited and encouraged to attend the big reveal of the headlines on October 16th at 3 p.m.

I’m sure at this point you’ve heard lots about the first time homebuyer tax credit, but what does it mean for you? Contrary to the title ‘First time Homebuyer’ you don’t necessarily need to be a first time homebuyer (check with your accountant to verify). The IRS describes first time homebuyers as someone who hasn’t owned a principal residence in the previous three years prior to purchasing a home.
The tax credit can be as much as $8,000! Here’s how it works. Buyers can take a tax credit (not a deduction) equal to 10 percent of the purchase-up to a maximum of $8000 off of their 2009 income taxes when filed next year. For example buy a house that’s $80,000 or more and you owe $8000 in taxes, you now would owe $0! Frederick County’s National Parks

Free evening program celebrates Frederick County’s National Parks with

a “sneak preview” of the new Ken Burns’ film, special guests, activities and displays

Thursday, September 24, 2009 – 7:30 p.m.

Frederick, MD - The Tourism Council of Frederick County, Maryland and the City of Frederick’s Weinberg Center for the Arts proudly announce a special program at the Weinberg Theater on Thursday, September 24, 2009 at 7:30 p.m. in celebration of Frederick County’s five National Park Service sites. The program is free and open to the public and offers a “sneak preview” of Ken Burns’ new documentary The National Parks: America’s Best Idea that premiers on PBS September 27, and special remarks from Peggy O'Dell, National Park Service Regional Director for the National Capital Region. During the evening presentation, the public can learn how they can become more engaged with the National Parks in our area.

Additionally, personnel and volunteers from the parks will be on hand with displays and activities to encourage guests to discover the “battle that saved Washington” at Monocacy National Battlefield, learn about the early fabric of our country as reflected in WPA and CCC projects at Catoctin Mountain Park, experience transportation history along the Chesapeake and Ohio Canal National Historical Park and enjoy the majestic splendor of the Appalachian National Scenic Trail, and the Potomac Heritage National Scenic Trail. Likewise, representatives from Maryland’s Heart of the Civil War Heritage Area and the Catoctin Mountain National Scenic Byway will share ways these resources can enrich National Park experiences in Frederick County. The heritage area and byway, both partners in the Journey Through Hallowed Ground National Heritage Area, are managed by the Tourism Council of Frederick County.

“Frederick County is proud to be the home of so many rich and diverse National Park Service resources,” say John Fieseler, director of the Tourism Council of Frederick County. The September 24 event is a free, family-oriented, program. “We hope you will join us on this occasion to celebrate our National Parks, and to encourage our citizenry to enjoy and care for America’s treasures, with a special focus on those in our own backyard.”

Residential Burglary


On 09/08/09 at 1042 hours Frederick Police Department officers responded to a residential burglary that had just occurred in the 1300 block of Peachtree Court. While en route the victim was able to give a detailed description of the suspect as she was leaving. Officer First Class Raymond Bednar located the vehicle as it was leaving the scene and detained the driver. An investigation revealed that the suspect entered the home of her ex-boyfriend without permission. The suspect had a knife with her and attempted to stab the ex-boyfriend. The victim was not injured by the knife but did sustain injuries as a result of the struggle. The suspect also stole personal items of the victim before leaving the house. The suspect was identified by both the victim and another resident of the house, who was home at the time of the burglary. The suspect was arrested by OFC. Bednar and transported to central booking, where she was awaiting a hearing with a commissioner. No further information is available at this time.

Assault

On 9-5-09, at approximately 0540 hours, officers from the Frederick Police Department were dispatched to an assault call in the 500 block of N. Market St. Upon arrival, officers contacted the victim. The victim told officers that one black male and two white males assaulted him and removed items from his pockets. The victim sustained minor injuries and was transported to FMH for treatment. There is no further information known at this time.

GAL PALS Program to begins September 9th

The Frederick Police Department, Police Activities League will offer the GAL PALS program beginning September 9th.

The GAL PALS program is designed to nurture and to help young girls of all backgrounds develop courage, confidence, and character. The vision is to help participants grow into well-adjusted, functional young women and future leaders in our community. This will be the 3rd year that the program has been offered and each month has featured topics as: Self-Confidence, Nutrition, First Aid, Career Choices, etc.

The GAL PALS program is for girls ages 10-15 and meets two times each month, September to mAY, at the Hillcrest Community Center. These meetings are conducted on the 2nd and 4th Wednesday’s of each month from 6:00-8:00 pm. The 1st meeting will be held on Wednesday September 9th and those interested in enrolling in this program can enroll at that time. The Hillcrest Community Center is located at 1150 Orchard Terrace, Frederick MD 21703.

The GAL PALS Program is but one aspect of the Department’s multi-faceted, progressive approach to policing in our community in general, and reaching out to the City’s youth specifically.

The Police Activities League of Frederick (PAL) began in August of 1999, and is a recreation-oriented juvenile crime prevention program that relies heavily upon athletics and recreational activities to create and cement the bond between police officers and the kids on the street. During the school year the PAL program is offered in the evenings at the PAL Center in the Sagner Community and at Hillcrest Elementary School. PAL offers kids a safe nurturing place to learn and interact with the police officers all while having a good time.

Home Invasion

On tonight’s date, at approximately 2245 hours, officers of the Frederick Police Department responded to a reported Home Invasion at 409 Mohican Dr. Two male residents reported that they were home alone when they responded to a knock at the door. Several unidentified men forced their way into the residence making demands. At the time of this release, the incident is being investigated by the Department’s Criminal Investigations Division. The suspects have not been apprehended and the incident is still being actively investigated at this time. Specific information will be released as the investigation evolves. Burglary Suspects Charged


On July 15, 2009 at approximately 4:20 am, Frederick Police Department officers responded to Country Hill Apartments at 1000 Heather Ridge Dr. for a report of a burglary. Upon arriving on scene, officers discovered numerous windows on the leasing office had been shattered. Inspection of the building revealed various items were missing from the office.

Later that same day, one of the missing items was located inside an apartment at the complex. During initial investigation, officers were able to identify a suspect as Isiah Jamal Fredericks. Based on evidence gathered at the scene, Fredericks was placed under arrest and charged with 2nd degree burglary, 4th degree burglary, malicious destruction of property greater than $500, theft less than $100 and theft less than $500. The case remained open pending additional investigation.

Follow up investigation by Det. Thomas Tokarz of the Criminal Investigation Division led to the identification of two additional suspects. On August 27, 2009 an arrest warrant was issued for Rafael Lopez Cardoza (photo right), age 19, charging him with 2nd degree burglary, 4th degree burglary, malicious destruction of property greater than $500, theft less than $100, theft greater than $500 and conspiracy to commit each of these offenses. On September 1, 2009 Det. Tokarz served Cardoza with the arrest warrant. Cardoza is being held at the Frederick County Adult Detention Center on $20,000 bond.

The other suspect identified by Det. Tokarz is a 17 year old juvenile male. Charges have been forwarded to the Department of Juvenile Services for the same offenses as Cardoza.
