Assault and Disorderly Conduct Arrests

On 01/11/2009 at approximately 0200 hours, OFC D. E. Stephenson was monitoring the area of the 100 block of S. Market St. as numerous local bars were in the process of closing. OFC Stephenson heard the sounds of an altercation and responded to the area of Citizen’s Way, where he discovered numerous people suffering from the effects of pepper spray and observed a male running from the area. Witnesses advised OFC Stephenson that the male had challenged the victims to a fight and had then pepper sprayed them and OFC Stephenson pursued the suspect and apprehended him a short distance away. At the time of his arrest, he was still in possession of a canister of pepper spray that had been used in the assault. This arrestee was identified as the below listed Nolan subject and was charged as listed. The investigation into Nolan’s actions continues.

While officers were dealing with the above situation, a second subject began interfering with the officers, yelling obscenities and causing a disturbance. He was told by several officers to cease his actions, but continued and was eventually arrested by OFC M. A. Irons. This subject was identified as the below listed Ruppert arrestee and was charged as listed.

Both arrestees were transported to Frederick County Central Booking where they were processed and had hearings before the District Court Commissioner who released both men on their own recognizance.
